You are conflating the legal parameters for consent with the colloquial understanding of consent.

There ARE states (and countries) where the legal age of consent is 16, so your final statement is flatly false. Even by your own insistence on the ‘legalist’ definition of consent, you are incorrect. The point is that there is a morally relevant dIfference between colloquially non-consensual rape and statutory rape.
